Be safe.
Although cellular phones can be tremendously useful, it is important to know the laws of when you can and cannot use your cell phone while driving.
The Texas Legislature has enacted two new laws regarding the use of cell phones which are now in effect:
(1) one banning teen drivers from using cell phones and text messaging devices;
(2) the other prohibiting drivers from using handheld cell phones in school crossing zones.
It is important for you to know the current prohibitions:
It is illegal to drive while using your cell phone if you are driving through a school zone. That is the law in San Antonio and Texas. You are allowed to use a hands-free device such as Bluetooth, speakerphone, and earpieces. However, texting while driving through school zones is specifically prohibited and violators can face fines up to $200.
Other restrictions are:
- Learners permit holders – CANNOT use handheld cell phones in the first six months of driving.
- Drivers under the age of 17 with restricted licenses – CANNOT use wireless communications devices.
- School bus operators – CANNOT use cell phones while driving if children are present.
- All Drivers – CANNOT use handheld devices in school crossing zones.
Be safe.
If you are involved in a car accident because someone was not paying attention, including not paying attention while driving and texting or using a cell phone against these laws, you have a right to recover for your damages.
